Rule 49 Disclsoure Statement

Rule 49 Disclosures are REQUIRED for all parties and include a very specific set of documents. Even if you are unrepresented, you will be expected to comply with all disclosure deadlines. Supplying disclosures provides the court and opposing party with the necessary financial information in order to divide assets and award you your share of the community property as well as determine spousal maintenance and child support if at issue. This is a critical step in every case for each party to complete. Without completing disclosure, you may forego your entitlement to certain assets and could even be assessed attorney fees by the court for failing to comply.

Preparation of Asset and Debt

If you need help outlining your assets and debts, we review disclosures and create a clear chart detailing asset value and your entitled share. This may be beneficial for individuals who have not otherwise had a lot of access to the finances during the marriage and have been provided with disclosures from the other side and don’t know where to start in analyzing what community assets they may be entitled to. The chart can be used in informal settlement discussions as well as for use at mediation.

Petition to Initidate Divorce (Petition for Dissolution)

In order to obtain a divorce, a request (or petition) seeking a divorce (or dissolution) of your marriage is necessary. Your request should set forth certain preliminary statements to the court including the assets at issue, the portion you are seeking and what you would like to do for custody of the children, if any.

Response (Answer) to Petition for Dissolutioni

After a Petition for Dissolution has been filed, you MUST file a Response to state what you agree and/or disagree with. The Response should set forth your own requests to the Court and is your opportunity to include anything that may have been left out of the Petition. If you were served with the Response in Arizona, you have 20 days to respond. If you were served outside of Arizona, you have 30 days to respond. If you fail to respond, THE CASE CAN PROCEED WITHOUT YOUR POSITIONS OR YOUR REQUESTS which can result in your spouse getting everything they have asked for without your input.

Petition to Establish Custody (Parenting Time, Legal Decision Making + Child Support)

If you do not have any current orders or agreements for custody but need to implement orders, you must file a Petition to Establish custody in family court. The Petition sets forth your requests to the court for custody including parenting time, decision making over the kids as well as child support. The Petition should also include some statements to support why you are requesting what you are to the Court. While the Court has fillable forms for parents to use, they do not include a lot of space to include specific requests to the court for certain items as well as any unique requests you may have with respect to the custody. A meeting with our firm to go over your requests will ensure your concerns are addressed in the Petition and that you are accurately requesting what you wish for custody arrangements.

Petition to Modify Custody (Parenting Time, Legal Decision Making and/or Child Support)

If you already have custody orders in place but want to seek a modification of those orders, we can help you prepare a request for a modification to the court that includes the necessary statutory and legal requirements, such as changed circumstances, as well as an explanation of your requests to the court and why you are making said requests.

Petition to Enforce a Court Order

If the other party is not complying with a court order, we draft a Petition to Enforce to ensure accountability and adherence to the existing order.

Emergency Motion for Temporary Orders

If you need to file an Emergency Motion for Temporary Orders because your child(ren) is in imminent danger (physical, mental, emotional psychological) we can help you prepare the Emergency Motion in order to seek an Emergency Ruling without a hearing. If granted, an evidentiary hearing will be set. However, because Emergency Motions seek orders from the Court or an expedient basis without a hearing, the burden is very high thus it is important to set forth all of your concerns to the Court and how the child(ren) may be harmed if court intervention does not occur.

Motion to Dismiss

If you are currently involved in active litigation and seeking a dismissal of a Petition or request made by the other party, our office will collaborate with you to prepare a Motion to Dismiss using the relevant Arizona legal authority to seek said dismissal. For example, a Motion to Dismiss a parents request to modify parenting time or legal decision making may be sought if the request fails to satisfy a mediation requirement prior to seeking court intervention or fails to satisfy the one year waiting period and change of circumstance requirement when seeking a modification of custody.

Pretrial Statement (for Trial) and Exhibits

One of our most popular flat fee services includes the preparation of a pretrial statement and exhibits. The pretrial statement is REQUIRED by all parties prior to an evidentiary hearing and sets forth your request to the court and the basis for said request. The statement should include any and all legal arguments as well as include a discussion about the evidence you plan to use at trial and how said evidence supports your case. Failure to complete a pretrial statement may have a severe negative impact on your case and may result in sanctions for failure to comply with the court’s directives. This flat fee services includes a one-on-one meeting with the attorney to go over your case, your request and construct the legal arguments to the court as well map out the evidence you have to support your requests. This is your chance to outline your case to the judge in order that they can issue a ruling that takes into account all of your positions. It is a critical opportunity for the judge to hear from you outside of the limited time you have at trial to present your testimony.
